Copyright Tribunal deals with two cases

The Copyright Tribunal has given time until the end of the month (28/08/07) to the Fiji Performing Right Association, Australasian Performing Rights Association Ltd and Fiji Television Limited to conduct further negotiations on a fee agreeable to both parties.

This was one of two cases involving licensing that the Tribunal deliberated on earlier last week (29/07/08) at its sitting in the Office of the Attorney General’s, Level 5 Conference Room, Suvavou House, Victoria Parade, Suva.

The orders of the Tribunal, stated that the parties would attempt to negotiate a fresh fee payable under the licensing scheme by 28th August, 2008.

However, the Tribunal said that the current scheme shall remain in operation until the matter would be dealt with by the Tribunal or unless otherwise agreed between the parties by the end of the month (August).

Meanwhile in the second case heard by the Tribunal on an application by a Mr Sohan Singh, the owner of the Macuata Theatre Company, which operates Diamond Theatre in Labasa, the Tribunal abandoned and dismissed the matter.

There were five grounds in which the Tribunal based its decision on:

- the matter was adjourned to 1st May 2008 for hearing and adjourned;

- a further 30 days was requested and given for Mr Singh to appear;

- a further extension was given for 30 days and the matter was adjourned to 29th July 2008;

- on 29th July 2008, the applicant nor his counsel appeared and neither was the applicant’s submissions filed as ordered and;

- since it was the third adjournment, the application was deemed abandoned and dismissed.

The three-member Tribunal consists of a Chairman, Mr Ajmal G Khan, a Resident Magistrate and the other two members are Mrs Marieta M Rigamoto and Ms Marie Chan.
